Personal and Non-Personal Information

This Privacy Policy explains how we treat both personal and non-personal information.

What is Non-Personal Information and how is it collected and used?

Non-personal information is data that does not identify you. If you visit the Site to read information (for example, about our services), we may collect certain non-personal information from your browser or device, such as IP address (when not linked to you), browser type, operating system, referring URLs, general location, and pages viewed. Because non-personal information does not identify you, we may use and share it without restriction, including to operate, maintain, analyze, and improve the Site.

What is Personal Information and how is it collected?

Personal information identifies you as an individual, such as your name, mailing address, email address, telephone number, and similar data. We may collect personal information when you:

Submit a contact form, application, engagement letter, or other form;

Conduct a transaction with us or our third-party service providers (e.g., payment processors);

Provide information in support of a transaction (e.g., billing details);

Schedule or attend consultations, strategy calls, or webinars;

Communicate with us via email, SMS, phone, or social media;

Choose to receive resources, newsletters, or offers; or

Participate in surveys, promotions, or events.

We may also obtain information from third-party sources (e.g., publicly available databases, referral partners) consistent with applicable law.

Cookies and Related Technologies

We may use cookies, web beacons, pixels, and similar technologies to operate and improve the Site, remember your preferences, and measure performance. Cookies are assigned to you and may only be read by the domain that set them. Web beacons are small graphics that help us understand Site usage (e.g., when a page was viewed).

You can set your browser to decline or delete cookies; doing so may limit certain Site features. Third-party analytics providers may also set cookies to help us analyze aggregated usage statistics.

How Kimball Consulting Uses Personal Information

We may use personal information to:

Provide access to the Site, products, and services;

Schedule and manage appointments, consultations, and communications (including SMS and email);

Respond to inquiries and provide client support;

Process payments and manage billing (through third-party processors);

Send resources, updates, and information about our services you request or that may be relevant to you;

Conduct research and improve our programs, content, services, and user experience;

Protect security, prevent fraud, and comply with legal or regulatory requirements; and

Enforce our Terms of Use and other agreements.

We may combine personal information collected online with information you provide through other channels. Once personal identifiers are removed, de-identified information is treated as non-personal information.

How We Share Personal Information

We do not sell your personal information to third parties for their independent marketing.

We may share personal information:

With service providers: Companies we engage to perform services (e.g., web hosting, analytics, CRM, SMS and email delivery, scheduling, payment processing). They are authorized to use personal information only as needed to provide services to us.

With referral or financing partners (at your direction): As part of our strategic financing advisory, and only with your knowledge or direction, we may introduce you to independent third-party providers. Those providers’ privacy policies govern their use of your information.

For legal, safety, or compliance reasons: To comply with law, regulation, legal process, or governmental request; to protect our rights, property, safety, clients, or the public; or to enforce our agreements.

Business transfers: In connection with a corporate sale, merger, reorganization, dissolution, or similar event, your information may be transferred as permitted by law, subject to the successor entity’s adherence to this Policy or a substantially similar policy.

SMS Campaigns: We will not share your SMS opt-in with any third party for purposes unrelated to delivering our messaging services. We may share your personal data (including your SMS opt-in or consent status) with vendors that help us deliver messages (e.g., platform providers and carriers). Text messaging originator opt-in data and consent will not be shared with third parties for their own marketing.

Communications

We may contact you via email, SMS, phone, or mail to provide information about programs, products, services, and content that may be of interest. You can opt out of marketing emails by using the unsubscribe link in those emails. For SMS, reply STOP to opt out and HELP for help. Standard carrier rates may apply. We cannot guarantee that email communications will be secure from unauthorized access during transmission.

Financing-Specific Note

Kimball Consulting is a strategic financing advisor, not a direct lender. If you choose to pursue financing with an independent third-party provider, your information will be handled in accordance with that provider’s privacy practices and agreements. We do not control third-party underwriting, decisions, or data handling.

Security

We implement generally accepted technical and organizational measures designed to protect personal information against loss, misuse, alteration, or unauthorized access. Access is limited to authorized personnel and vetted service providers who are required to keep information confidential. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Links to Other Sites

The Site may contain links to third-party websites. We are not responsible for the privacy practices or content of such sites. Please review their policies before providing information.

Public Discussions and Testimonials

Information you post in public areas (e.g., comments, forums, social media) may become public and be collected and used by others. Avoid posting sensitive information. If you provide a testimonial, we may display it with your permission consistent with applicable law.

Access, Correction, and Deletion

You may request access to, correction of, or deletion of your personal information by following instructions on the Site (if available) or contacting us at [email protected]. We will respond within a reasonable timeframe and in accordance with applicable law. You may also unsubscribe from email lists using the link in any marketing email.

If you are a resident of a jurisdiction with specific privacy rights (e.g., certain U.S. states or countries), you may have additional rights regarding access, deletion, correction, and opt-out of certain sharing. To exercise these rights, contact us using the information below.

Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us and we will take appropriate steps to delete it.

Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated “Last updated” date. Material changes may also be highlighted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.
